E.g., it would be kind of difficult to sell patches for a Fractal Axe-Fx II without identifying the unit the patch was designed to run on. Consider, "A bluesy patch for the latest rack unit made by that company in New Hampshire owned by the guy whose initials are C.C.," versus, "A bluesy patch for Fractal Audio's Axe-Fx II XL+." One of those works in the marketplace, the other ... not so much. Hence the exception.
Well of course, You have to write "patch for this or that" but I wasn't referring to that particular instance.
"Watermmark" isn't the right word, "Logo" is what I actually meant: slamming a Logo of any company on video (or whatever you're doing) to sell stuff without the "Ok" of the company isn't legal.
To recap:
- It is legal to sell Fractal Presets (Doesn't matter if your own or a by copy "X famous guy"); it would be better If You made it present to the company (but it's not required).
- It is legal to "reproduce" "X famous guy" tone for selling purpose (unless it is a trade mark?)
- It is not legal to take a Logo and put it on Your stuff (unless you have a permit or a disclaimer).
- It is not "morally" legal to copy someone else's stuff and claim it is Your own (Duh!) and selling said stuff.
I guess that sums it up?
